Cohabitation can be important to prove, particularly whilst navigating through a divorce. The Form E element of a divorce is where a couple’s finances are stringently looked at and assets are split. If one of the couple has moved on and is in a new relationship, and they reside together, then this needs to be taken into account. The reason being is that if the new partner is earning then this needs to be taken into account. This can change the percentage split on the Form E. Sometimes, a previous partner might be aware of this and therefore not declare the fact that they are residing with a new partner. If this is suspected, then we can help!

Cohabitation Surveillance Methods

There are two ways in which this can be investigated. If time is of the essence due to a forthcoming court date, then we would advise performing surveillance utilising one surveillance operative for two and a half hours in an evening evidencing the new partner or ideally both returning to the property after work. We would then repeat this the following morning to evidence either both leaving the address or at a minimum the new partner. This will hopefully evidence one or both in different clothing than the night before, proving that they have a wardrobe of clothes at the address.

This needs to be repeated as many times as the budget will allow over a 2-week period with no days repeated. So, for example, week one may consist of the below observations.

• Monday evening / Tuesday morning
• Wednesday evening / Thursday morning
• Friday evening / Saturday morning

Week two will then be.

• Tuesday evening / Wednesday morning
• Thursday evening / Friday morning

This will cost £300+VAT for each evening and morning. So over a two-week period it will cost £1500+VAT (£1800).

The second method is when we randomly choose one day a week to monitor the address from for example 4pm until half an hour after all lights are distinguished. This would generally be an eight-hour deployment costing £480+VAT. This would then be repeated on a different day the following week. This can be performed on a weekly basis to show a pattern until the court date or an agreed time.

We will then provide you with a report documenting our findings which will include images taken from the surveillance footage. This report forms an exhibit and is completely admissible in court.

It is important to discuss both potential courses of action with your Solicitor or Barrister as they are the ones who will have to be happy using and potentially disclosing our findings. Some Solicitors may find this to be inconclusive or overly intrusive. We find that this is rarely the response we receive, however it has been known. So this reinforces speaking to your Solicitor.

This is a completely legal course of action as long as the imagery is gained legally. For example, not trespassing to gain the imagery.

We mentioned that one surveillance operative would be utilised to gain the evidence. Generally, they will be parked up with a view of the property in question in a vehicle which will appear empty. We won’t be sat outside the address in the driver’s seat with a camera in hand. The idea is that we blend into the environment and no one knows that we are present.
