Physical Surveillance V’s GPS Vehicle Tracking Devices
Physical surveillance and GPS vehicle tracking devices are two tools which can be utilised to monitor a person’s movements, either separately or together.
Let’s look at GPS vehicle tracking devices first. A GPS vehicle tracking device is an intelligence tool to aid a surveillance. What we mean by this is that a GPS vehicle tracking device deployed alone will not provide evidence. It will merely provide location data of the vehicle which it is attached to. It will show the data live time, or it can be interrogated after the event as it records all location data. It will not inform you of who is driving the vehicle or who other occupants are. It will not inform you of where the driver and/ or occupants go after parking up. It will merely monitor and record the movements of the vehicle.
GPS Vehicle Tracking Devices
The GPS vehicle tracking device may be used to identify routine so that a surveillance team can be intelligently deployed at a later date. It maybe that just the GPS vehicle tracking device deployed on its own is enough and the surveillance team aren’t required to be deployed.
So, in essence, a GPS vehicle tracking device is an intelligence tool. Its data is not evidential on its own so therefore it does not form personal information for the purposes of the Data Protection Act 2018 and the General Data Protection Regulation.
GPS vehicle tracking devices are deployed on a seven day basis for a fee of £420 inclusive of VAT.
Physical Surveillance
Let’s look at physical surveillance. This is usually imposed when a client knows that an event is going to happen or at least there is a suspicion that it will or there is an opportunity for it to happen. A minimum of two surveillance operatives are deployed at an agreed time and location to covertly monitor and record locations attended by the subject, associations and body language. The operatives will gain covert footage throughout the deployment which is no less than five hours in duration. The hourly fee of an operative is £60 inclusive of VAT so therefore a minimum deployment of five hours costs £600 inclusive of VAT. Any mileage incurred during the deployment is charged at £0.50/mile and any necessary expenses are chargeable to the client. For example, the subject travels on public transport and travel expenses are gained by the operatives to keep control of him/ her. The client is kept up to date live time by the case handler and this may include imagery as it is taken if so required.
If the minimum surveillance of five hours is coming to an end and the client wishes for the surveillance operatives to remain in situ, then this can be done on an hour by hour basis at the same rate of pay of £60/ hour per operative.
Within 24 hours from the termination of the deployment the client will receive a comprehensive report which includes still images taken from the surveillance footage. The unedited surveillance footage is also available upon request.
Clearly, if the subject is seen by the operatives and video imagery is gained, then this footage is classed as personal information for the purposes of the Data Protection Act 2018 and the General Data Protection Regulation. This information therefore has to be handled, retained and deleted in accordance with these guidelines.
Let’s look at physical surveillance and GPS vehicle tracking devices where they are used together. It may be that we are conducting surveillance on “a surveillance aware subject”. This is when a subject;
- Has been under surveillance previously and compromised the surveillance team, or
- Is expecting surveillance to be imposed, or
- Is aware of surveillance tactics.
In any of these situations, it may be justified to deploy a GPS vehicle tracker in conjunction with a surveillance team to maintain control of the subject, however utilising the GPS vehicle tracker to reduce the exposure of the operatives.
