Mobile Phone Hacking – Can you access my partner’s mobile telephone?
Can you access my partner’s mobile phone data?
This is a question we are asked time and time again here at Titan by potential clients who require a matrimonial investigation. This is usually due to suspecting their partner of ‘sex texting’ or having a relationship with another party and evidence may be on an app or text message within a mobile telephone, computer or other device.
We can perform a full forensic download of a mobile telephone which will retrieve all data on the telephone. This can only be done lawfully within England & Wales with the owner’s/ user’s consent. The download retrieval will include;
- Deleted text messages.
- Deleted photos.
- Call logs despite the call being manually deleted from the call log.
- Deleted social media messages.
- Deleted emails.
This isn’t an exhaustive list; however, all data will be retrieved and documented utilising similar software to that which the UK Police utilise. This is only lawfully possible with the permission of the owner of the telephone. The telephone will be required to be delivered to one of Titan’s nine offices in person or by courier/ Royal Mail Special Delivery, which is guaranteed the following day prior to 1300 hours.
If this is instructed by a client without the permission of the owner/user and is performed by an investigation agency who is aware that permission has not been gained, then offences are committed by both parties and come with consequences. The array of offences committed are serious and are.
- Section 1 of the Computer Misuse Act 1990.
- Intent to secure unauthorised access to the contents of a computer / mobile telephone. There has to be knowledge on the part of the offender, so this would apply to the person instructing and the investigation agency, that the access is unauthorised. The offence is committed irrespective of whether access is obtained.
- Offences under sections 170 to 173 of the Data Protection Act 2018.
- Knowingly obtaining data without consent.
- Disclosing any personal data to another person without consent.
- Selling personal data disclosed or retained without consent.
- Section 32 of the Criminal Justice and Courts Act 2015 makes the offence a maximum penalty of two years’ imprisonment.
- Section 127 of the Communications Act 2003.
- Is committed if you were to send a message from your partner’s phone with the intention of causing annoyance, inconvenience or needless anxiety to another.
- Other options may cause consideration to be given to the:
- Counterfeiting and Forgery Act 1981.
- Video Recordings Act 2010,
- Registered Designs Act 1949.
Examples of previous convictions of this are Ian Edmondson, former News of the World Editor, was jailed for 18 months for mobile phone hacking.
Andy Coulson, formerly of News of the World, was jailed for 8 months.
We’re all aware of the current civil prosecution case at the time this was written which is brought to the court by Prince Harry against the Publisher of The Mirror for mobile phone hacking of his phone, his wife’s Megan and their associates.
The headlines on 7th July 2023 were, “Convicted phone hacker whose evidence is helping Prince Harry to sue newspapers threatened to destroy a Private Investigator unless he came on side, court hears.”
So, in essence, no it is not possible to hack your partner’s mobile telephone due to the laws within England & Wales. Any investigation agency that does offer this service is either happy to go to prison and take you with them, or it’s a con or a scam. Probably the latter.
